Thematic Priority – Rule of Law

The rule of law remains weak in Myanmar, with repressive laws in effect, a judiciary that is neither independent nor effective, local governance and security services that are still under the control of the military through the Ministry of Home Affairs, and restrictions on fundamental freedoms of expression, association, assembly, religion and belief. Thus, justice and accountability for human rights violations is often elusive, and rights-based civil society remains at risk of persecution. Many of these problems are structural and deep-rooted, allowing impunity to continue. We advocate for an enabling environment whereby human rights defenders and activists can work freely towards developing an open, just and tolerant society, whereby people’s fundamental rights, whether through practising a religion of their choice or engaging in peaceful protest against injustice, are respected and protected.

ဖိႏွိပ္သည့္ ဥပေဒမ်ား ဆက္ရွိေနျခင္း၊ တရားစီရင္ေရးသည္ လြတ္လပ္အမွီခုိကင္းမႈႏွင့္ ထိေရာက္မႈ ကင္းမဲ့ ေနျခင္း၊ ေဒသဆုိင္ရာအုပ္ခ်ဳပ္ေရးႏွင့္ လံုျခံဳေရးတပ္ဖဲြ႔မ်ားသည္ ျပည္ထဲေရး၀န္ႀကီး႒ာနမွတစ္ဆင့္ စစ္တပ္ထိန္းခ်ဳပ္မႈ ေအာက္တြင္ ရွိေနျခင္းႏွင့္ လြတ္လပ္စြာ ဖြင့္ဟေဖာ္ထုတ္ခြင့္၊ အဖဲြ႔အစည္းဖဲြ႔စည္းခြင့္၊ စုေ၀းခြင့္ႏွင့္ ယံုၾကည္ ကုိးကြယ္ခြင့္ တုိ႔ကဲ့သုိ႔ အေျခခံအခြင့္အေရးမ်ားသည္ ကန္႔သတ္ထိန္းခ်ဳပ္ခံေနရဆဲ ျဖစ္ေနေသးသည့္အတြက္ ျမန္မာႏုိင္ငံတြင္ တရားဥပေဒစုိးမုိးေရးမွာ အားနည္းေနဆဲျဖစ္ပါသည္။ ထုိ႔ေၾကာင့္ လူ႔အခြင့္အေရး ခ်ိဳးေဖာက္မႈမ်ားအတြက္ တရားမွ်တမႈ ႏွင့္ တာ၀န္ယူမႈ၊တာ၀န္ခံမႈတုိ႔ကုိ ျမင္ရခဲၿပီး လူ႔အခြင့္အေရး ဦးစားေပးလုပ္ေဆာင္သည့္ အရပ္ဘက္လူထုအဖဲြ႔အစည္း မ်ားမွာ  ႏွိပ္ကြပ္ခံရမည့္ အႏၱရာယ္ႏွင့္ မၾကာခဏဆုိသလုိ ရင္ဆုိင္ေနၾကရပါသည္။ ထုိျပႆနာမ်ားထဲမွ အမ်ားအျပားမွာ ဖဲြ႔စည္းတည္ေဆာက္ပံုဆုိင္ရာ ျပႆနာမ်ားျဖစ္ကာ နက္နက္ရိႈင္းရိႈင္း အျမစ္တြယ္ေနၿပီး အျပစ္ေပး အေရးယူခံရျခင္းမွ ကင္းလြတ္ခြင့္ကုိ ဆက္လက္ရွင္သန္ေစရန္ ခြင့္ျပဳေပးေနပါသည္။ မိမိတုိ႔အေနျဖင့္ တစ္ဦးခ်င္း၏ ဆႏၵႏွင့္ ေရြးခ်ယ္မႈအရ ယံုၾကည္ရာ ဘာသာတစ္ခုအား လက္ေတြ႔က်င့္သံုး ကုိးကြယ္ျခင္း သုိ႔မဟုတ္ တရားမမွ်တမႈအား ၿငိမ္းခ်မ္းစြာဆန္႔က်င္ဆႏၵျပျခင္းတုိ႔ကဲ့သုိ႔ ျပည္သူလူထုမွ ၎တုိ႔၏ အေျခခံအခြင့္အေရးမ်ားကုိ က်င့္သံုးျခင္းအား ေလးစားလုိက္နာကာ ကာကြယ္ေပးမည့္ ပြင့္လင္း တရားမွ်တ သေဘာထားႀကီးသည့္ လူ႔အသုိင္းအ၀ုိင္း ေပၚထြန္းေရး အတြက္ လုပ္ကုိင္ေနၾကသည့္ လူ႔အခြင့္အေရး ကာကြယ္ ေစာင့္ေရွာက္သူမ်ားႏွင့္ တက္ၾကြလႈပ္ရွားသူမ်ား လြတ္လပ္ လံုျခံဳ စိတ္ခ်စြာ လုပ္ေဆာင္ႏုိင္မည့္ ၀န္းက်င္တစ္ခု ဖန္တီးတည္ေဆာက္ေရးအား စည္းရံုးလံႈ႔ေဆာ္ လုပ္ေဆာင္ပါသည္။

ေရွ႕ေျပးအသံအဖဲြ႔မွ ၎၏ ဦးစားေပးအေၾကာင္းအရာမ်ားထဲ တစ္ခုျဖစ္ေသာ – တရားဥပေဒစုိးမုိးေရး အခန္းက႑ႏွင့္ပတ္သက္ၿပီး အစီရင္ခံစာမ်ား ထုတ္ျပန္ထားပါသည္။ ထိုအစီရင္ခံစာမ်ားကို ေအာက္တြင္ဖတ္ရႈႏိုင္ပါသည္။
