မြန်မာနိုင်ငံ၏ အသရေဖျက်မှုဥပဒေများသည် ဒီမိုကရေစီနှင့်ဆန့်ကျင်ဘက်ဖြစ်နေကြောင်း လွှတ်တော်၏ အသိအမှတ်ပြုမှုကို ပြသသော်လည်း ဝေဖန်ထောက်ပြသူများအား အပြစ်ပေးအရေးယူနေသည့် အခွင့်အာဏာကိုမူ ဤနိုင်ငံသားများ၏ ပုဂ္ဂိုလ်ဆိုင်ရာလွတ်လပ်မှုနှင့် ပုဂ္ဂိုလ်ဆိုင်ရာလုံခြုံမှုကို ကာကွယ်ပေးရေး ဥပဒေပြင်ဆင်ချက်မှ ရပ်တန့်စေလိမ့်မည် မဟုတ်ပေ။ ထိုကြောင့် ဥပဒေပြင်ဆင်ချက်ကို ပိုမို အကျယ်တဝံ့ ပြင်ဆင်ဆောင်ရွက်ရန် လိုအပ်ပါသည်။

အဆိုပါ နိုင်ငံသားများ၏ ပုဂ္ဂိုလ်ဆိုင်ရာလွတ်လပ်မှုနှင့် ပုဂ္ဂိုလ်ဆိုင်ရာလုံခြုံမှုကို ကာကွယ်ပေးရေး ဥပဒေအား ပြင်ဆင်သည့် ဥပဒေကို ၂၀၂၀ ပြည့်နှစ်၊ ဩဂုတ်လ ၂၆ရက် တွင် လွှတ်တော်မှ အတည်ပြုပြဌာန်း ခဲ့သည်။  မူလ “နိုင်လွတ်လုံ ဥပဒေ ”(၂၀၁၇)သည် လူတစ်ဦးတစ်ယောက်ချင်းစီ အပေါ် အထိန်းအကွပ်မဲ့ စောင့်ကြပ်မှုအား ကာကွယ်ရန် အပေါ်ယံသွင်ပြင်လောက်သာ ရည်ရွယ်ခဲ့သည်။ မည်သို့ပင်ဖြစ်စေ ၎င်းတွင် မရှင်းလင်း၍ အလွန်အမင်း ကျယ်ပြန့်မတိကျသော ရာဇဝတ်မှုဆိုင်ရာ အသရေဖျက်မှု ဥပဒေဖော်ပြချက်များ ပါဝင်နေသောကြောင့် အပြင်းအထန်ဝေဖန်ခံခဲ့ရသည်။

မြန်မာနိုင်ငံတွင် ရာဇဝတ်မှုဆိုင်ရာ အသရေဖျက်မှုနှင့်ပက်သက်၍ သိသာထင်ရှားသော ပြဿနာတစ်ရပ် ရှိသည်။ လူတိုင်းတွင် မိမိဂုဏ်သိက္ခာကိုကာကွယ်ခွင့်ရှိသင့်သော်လည်း အမြဲလိုလို ရာထူးအာဏာရှိသော တိုင်ကြားသူများကိုသာ အရေးပေးဆောင်ရွက်နေကြသောကြောင့် ရာဇဝတ်မှုဆိုင်ရာ အသရေဖျက်မှု ဥပဒေများသည် ဘက်လိုက်မှုရှိပြီး၊ ကျူးလွန်သည့် ပြစ်မှုထက် ပိုမိုပြင်းထန်သည့် ပြစ်ဒဏ်များ ချမှတ်နိုင်ခြင်းကြောင့် ဒီမိုကရေစီစံနှုန်းနှင့် ဆန့်ကျင်လျက်ရှိသည်။ ဤသို့ဘက်လိုက်ဆောင်ရွက်မှုများနှင့် ပြစ်မှုပြစ်ဒဏ်မမျှတခြင်းသည် ဝေဖန်ထောက်ပြမှုများကို တားမြစ်‌ပိတ်ပင်နေပြီး အကျင့်ပျက်ခြစားမှုများကို ခွင့်ပြုအားပေးရာ ရောက်နေသည်။  မြန်မာနိုင်ငံတွင် နိုင်ငံသားများ၏ ပုဂ္ဂိုလ်ဆိုင်ရာဥပဒေ အပါအဝင် ခြောက်ခုထက်မနည်းသော ရာဇဝတ်မှုဆိုင်ရာ အသရေဖျက်မှုဥပဒေများ ရှိနေပြီး၊ ယင်းတို့သည် ပုံမှန်အားဖြင့် သတင်းထောက်များ၊ လူ့အခွင့်အရေးကာကွယ်စောင့်ရှောက်သူများနှင့် အာဏာရှိသူများအား တာဝန်ယူမှု တာဝန်ခံမှု ရှိစေရန် ကိုင်တွယ်နေကြသည့် အခြားသူများကို အပြစ်ပေးအရေးယူရာ၌ လွဲမှားစွာ အသုံးချခံနေကြရသည်။

အဆိုပါ ပြင်ဆင်ချက်တွင် ရာဇဝတ်မှုဆိုင်ရာ အသရေဖျက်ခြင်းနှင့် ပတ်သက်သော ပြင်ဆင်ချက်နှစ်ခုအပါအဝင် နိုင်ငံသားများ၏ ပုဂ္ဂိုလ်ဆိုင်ရာလွတ်လပ်မှုနှင့် ပုဂ္ဂိုလ်ဆိုင်ရာလုံခြုံမှုကို ကာကွယ်ပေးရေး ဥပဒေကို ပြောင်းလဲပြင်ဆင်မှုလေးချက် ပြုလုပ်ထားသည်။ ပြင်ဆင်ချက်နှစ်ခုသည် တရားစွဲဆိုခံရမည့်သူများကို “တာဝန်နှင့်လုပ်ပိုင်ခွင့်ရှိသူများ” ဟုသာ တားမြစ်ကန့်သတ်လိုက်သည်။ ယခင်က မည်သူမဆို တရားစွဲဆိုခံရနိုင်ခဲ့ရာ ယခုပြင်ဆင်ချက်ဥပဒေအောက်တွင် အသရေဖျက်မှုအတွက် အစိုးရအရာရှိများသာလျှင် တရားစွဲဆိုခံရနိုင်သည်ဟု ဟု သက်ရောက်သည်။ ဤအဓိပ္ပါယ်ဖွင့်ဆိုချက်မှာ စစ်ဘက်ဆိုင်ရာအရာရှိများ ပါဝင်ခြင်းရှိ၊မရှိ မရှင်းလင်းပေ။

မြန်မာနိုင်ငံတွင်ရာဇဝတ်မှုဆိုင်ရာ အသရေဖျက်မှုဥပဒေများသည် လွဲမှားစွာအသုံးချခံနေရကြောင်း လွှတ်တော်၏ သွယ်ဝိုက်သောအားဖြင့် အသိအမှတ်ပြုပြင်ဆင်မှုကို FEMမှ ကြိုဆိုပါသည်။ လွှတ်တော်အမတ်များသည် လွတ်လပ်စွာထုတ်ဖော်ပြောဆိုခွင့်ကို ကာကွယ်ပြီး မြန်မာနိုင်ငံ၏ ဒီမိုကရေစီ အသွင်ကူးပြောင်းမှုကို အထောက်အကူဖြစ်စေရန် ပြုပြင်ပြောင်းလဲမှုများ လုပ်ဆောင်ရန်စိတ်ဆန္ဒရှိကြောင်းနှင့် ဥပဒေအားလွဲမှားအသုံးချမှုကို သတိပြုမိကြောင်း အဆိုပါပြင်ဆင်ချက်က ပြသသည်။

မည်သို့ပင်ဖြစ်စေ အဆိုပါ ပြင်ဆင်ချက်သည် နိုင်ငံသားများ၏ပုဂ္ဂိုလ်ဆိုင်ရာလုံခြုံရေးပါ ရာဇဝတ်မှုဆိုင်ရာ အသရေဖျက်ခြင်း ဥပဒေအား တလွဲအသုံးချနေမှုကိုတစ်စိတ်တစ်ဒေသ ပိတ်ပင်နိုင်သော်လည်း ယင်းသက်ရောက်မှုမှာ အနည်းငယ်သာဖြစ်ပြီး ကာလတိုတောင်းမည်ကို FEM မှ စိုးရိမ်သည်။ တိုင်ကြားသူများသည် မြန်မာနိုင်ငံ၏ အခြားရာဇဝတ်မှုဆိုင်ရာ အသရေဖျက်မှုဥပဒေ ၅ ခုအနက် တစ်ခုကို ရိုးရှင်းစွာ အစားထိုးအသုံးပြုနိုင်လိမ့်မည်။ ထိုသို့အစားထိုးသုံးစွဲပါက နိုင်လွတ်လုံဥပဒေမှ ဖြစ်ပေါ်စေခဲ့သည့် အာဏာရှိသူများမှ ဝေဖန်မှုများကို အရေးယူရန် တလွဲအသုံးချမှု ပြဿနာသည် ပျောက်ကွယ်မသွားဘဲ ဆက်လက်တည်ရှိနေလိမ့်မည်။

ဤကဲ့သို့ ဒီမိုကရေစီနှင့်ဆန့်ကျင်ဘက်ဖြစ်နေသည့် မြန်မာနိုင်ငံ၏ရာဇဝတ်မှုဆိုင်ရာ အသရေဖျက်မှုဥပဒေများမှ ဖြစ်ပေါ်‌သော ပြဿနာများကို ဖြေရှင်းရန် လွှတ်တော်၏ကြိုးပမ်းမှုသည် ယခုအခါ ဒုတိယအကြိမ်ဖြစ်သည်။ ၂၀၁၇ ခုနှစ်ကလည်း အရပ်ဘက်အဖွဲ့အစည်းများထံမှ သိသာသောဖိအားပေးမှုများနောက်တွင် အစိုးရသည် နာမည်ဆိုးဖြင့် ကျော်ကြားနေသော ရာဇဝတ်မှုဆိုင်ရာ အသရေဖျက်မှု ပြဌာန်းချက် ပုဒ်မ၆၆(ဃ) ဖြစ်သည့် ဆက်သွယ်ရေး ဥပဒေပြင်ဆင်ချက်ကို တစိတ်တပိုင်းအားဖြင့် ပြင်ဆင်ပေးခဲ့သည်။ ၎င်းဆက်သွယ်ရေးဥပဒေ ပြင်ဆင်ချက်သည် ယခု နိုင်လွတ်လုံ ဥပဒေ ပြင်ဆင်ချက်နှင့် အလားသဏ္ဍာန်တူခဲ့သည်။ ၎င်းတွင် တိုင်ကြားသူများမှ အခြားသောရာဇဝတ်မှုဆိုင်ရာ အသရေဖျက်မှုဥပဒေတခုခုကို အစားထိုး အသုံးမပြုခင် အထိသာ တိုင်ကြားမှုများအပေါ် ယာယီသက်ရောက်ခဲ့သော ဘာသာစကား အသေးစား ပြောင်းလဲမှုသာ ပါဝင်ခဲ့သည်။

မတူကွဲပြားသောဥပဒေများအား အသုံးပြုခြင်းကို “ဥပဒေရွေးချယ်ခြင်း” သို့မဟုတ် “ဥပဒေကို စိတ်ကြိုက်ရွေးယူခြင်း”ဟုခေါ်ပြီး၊ ကိစ္စရပ်တစ်ခုတည်းအတွက် ပုံစံတူဥပဒေအများအပြားရှိသည့် နိုင်ငံများတွင် ဖြစ်ပေါ်လေ့ရှိသော ပြဿနာတစ်ရပ် ဖြစ်ပါသည်။ ဥပဒေရွေးချယ်ခြင်းသည် တရားဥပဒေစိုးမိုးမှု အားနည်းသည့်နိုင်ငံများ၏ လက္ခဏာလည်းဖြစ်သည်။ ယင်းသည် လူထုကြားတွင်သာမက ဥပဒေပြုသူများနှင့် တရားရုံးများအကြားတွင် နားလည်မှုလွဲမှားခြင်းများ ဖြစ်ပေါ်စေနိုင်သည်။ ဥပဒေရွေးချယ်ခြင်းသည် အာဏာရှိသူများအား တရားဥပဒေကို လွှမ်းမိုးခြယ်လှယ်ရန် အထောက်အကူပေးသည်။

မြန်မာနိုင်ငံအတွက်တစ်ခုတည်းသော ဖြေရှင်းနည်းသည် ၎င်းပြဿနာ၏ အရင်းအမြစ်အကြောင်းအရင်း ဖြစ်သည့် ရာဇဝတ်မှုဆိုင်ရာ အသရေဖျက်မှုဥပဒေမူဘောင်တစ်ခုလုံးကို ပြုပြင်ပြောင်းလဲ၍ဖြေရှင်းရန်သာ ဖြစ်ပါသည်။

လူထု၏ဂုဏ်သိက္ခာ နှင့် အသရေဖျက်မှုဥပဒေများအား တလွဲအသုံးချနေခြင်း စသည့်ကိစ္စရပ်နှစ်ခုလုံးကို အကာကွယ်ပေးနိုင်မည့် ဥပဒေပြုပြင်ပြောင်းလဲရေးကို ပြုလုပ်ရန် ရွေးချယ်စဉ်းစားစရာ နည်းလမ်းလေးခုကိုလည်း တည်ဆောက်ထားသည်။ အကယ်၍ ဤနည်းလမ်း လေးခုထဲမှ တစ်ခုခုကိုသာ အကောင်အထည်ဖော်ခဲ့မည်ဆိုပါက မြန်မာနိုင်ငံ၏ ရာဇဝတ်မှုဆိုင်ရာ အသေရေဖျက်မှု ဥပဒေအား တလွဲအသုံးပြုနေမှု ပြဿနာများကို ဖြေရှင်းနိုင်ခဲ့လိမ့်မည် ဖြစ်သည်။

၄င်းတို့မှာ

  • ရာဇဝတ်မှုဆိုင်ရာ အသရေဖျက်ခြင်း ဥပဒေများအားလုံး ဖျက်သိမ်း၍ တရားမမှုဆိုင်ရာ အသရေဖျက်ခြင်းဥပဒေကို အတည်ပြုခြင်း။

ရာဇဝတ်မှုဆိုင်ရာ အသရေဖျက်မှုဥပဒေမူဘောင်တစ်ခုလုံးကို တစ်ကြိမ်တည်းနှင့် အလုံးစုံသက်ရောက်စေမည့် ဒီမိုကရေစီအသွင်ပြောင်းလဲပေးရန်ကိုပါ အလေးအနက်စဉ်းစားသုံးသပ်ကြရန် အစိုးရ ၊လွှတ်တော်အမတ်များနှင့် ၂၀၂၀ အထွေထွေရွေးကောက်ပွဲတွင် ပါဝင်ယှဉ်ပြိုင်မည့် နိုင်ငံရေးပါတီများကို FEM မှတိုက်တွန်းလိုက်ပါသည်။


Parliament has shown some recognition that Myanmar’s defamation laws are anti-democratic, but the new Privacy Law Amendment will not stop the powerful from punishing critics, and needs to be followed by broader reform.

The Amendment to the Law Protecting the Privacy and Security of Citizens was adopted by parliament on 26 August 2020. The original 2017 “Privacy Law” was ostensibly intended to prevent rampant State surveillance of individuals. However, it has been heavily criticised since because it also includes a vague and overly-broad criminal defamation provision.

Myanmar has a significant problem with criminal defamation. While everybody has a right to a reputation, criminal defamation laws are anti-democratic because they are biased in favour of complainants who are usually people in positions of power, and the punishment is disproportionately harsh. This bias and harshness dissuades criticism and empowers the corrupt. Myanmar has no less than six criminal defamation laws, including the Privacy Law, and they are regularly misused to punish journalists, human rights defenders, and others holding the powerful to account.

This Amendment makes four changes to the Privacy Law, including two changes that relate to criminal defamation. The two changes restrict who can be prosecuted to only those with “responsibility and authority”. The implication is that only government officials can be prosecuted for defamation under the law, whereas previously any person could be prosecuted. It is unclear whether the new definition would also include military officials.

FEM welcomes parliament’s implicit recognition that criminal defamation laws are being misused in Myanmar. The Amendment demonstrates that MPs are aware of this misuse, and are willing to make changes to protect freedom of expression and enable Myanmar’s transition to democracy.

However, FEM is concerned that although this Amendment may partially discourage misuse of the criminal defamation provisions in the Privacy Law, the effect will be minimal and short-lived. Complainants will simply use one of Myanmar’s five other criminal defamation laws instead. The problem caused by the Privacy Law – misuse by the powerful to punish criticism – will continue unabated.

This is the second time that parliament has tried to address the problems caused by Myanmar’s anti-democratic criminal defamation laws. In 2017, following significant pressure from civil society, the government adopted the Telecommunications Law Amendment, which partially reformed the notorious criminal defamation provision, Article 66(d). The Telecommunications Law Amendment was similar to this new Privacy Law Amendment. It included a small change in language which temporarily affected prosecutions until complainants simply started using a different criminal defamation law.

Using different laws is called “law shopping” and is a problem caused when countries have too many laws on the same issue. Law shopping is symptomatic of countries with weak rule of law. It causes misunderstandings about the law among the public as well as among legislators and courts. Law shopping enables those with power to manipulate the law.

The only solution in Myanmar is to address the root cause of the problem: reform the whole criminal defamation framework.

FEM has been consulting with parliamentarians and civil society and has developed four options to reform the laws in a manner that would both protect people’s reputations and prevent the misuse of defamation laws. If any of these four options were adopted, Myanmar’s problem with the misuse of criminal defamation would be solved. They are:

  1. Adopt a Civil Defamation Law, repealing all criminal laws
  2. Add stronger defences to the Penal Code
  3. Remove all prison sentences
  4. Limit to “Deliberate and serious defamation”

FEM urges the government, MPs, and political parties contesting the 2020 general election to seriously consider democratising Myanmar’s entire criminal defamation framework once and for all.
